These Terms of Service govern your access to and use of fenxdigital.com and any content, functionality, or forms offered on or through it. By using the site you agree to these terms. If you do not agree, please do not use the site.
The site is operated by FENX Digital (“FENX Digital”, “we”, “us”). You can reach us at hello@fenxdigital.com.
Use of the site
You may use this site for lawful purposes only. You agree not to attempt to gain unauthorized access to the site or its underlying systems, interfere with its operation, scrape or harvest data at scale, submit false or misleading information, or use the site to transmit unsolicited commercial messages or malicious code.
We may suspend or restrict access to the site at any time, with or without notice, including for maintenance or to protect the site and its users.
Inquiries and submissions
Submitting the contact form or subscribing to our updates does not create a client relationship or oblige either party to enter into an engagement. Information you submit is handled as described in our Privacy Policy.
You confirm that the information you submit is accurate and that you have the authority to submit it on behalf of any company you name.
Services and engagements
Any services we provide are governed by a separate written agreement, statement of work, or proposal signed by both parties. Where those documents conflict with these terms, the signed agreement controls for that engagement.
Descriptions of services, case studies, timelines, and results on this site are provided for information only. Past performance is not a guarantee or prediction of future results; marketing outcomes depend on many factors outside our control, including your market, offer, product, budget, and third-party platform behaviour.
Intellectual property
The site and its contents — including copy, design, graphics, logos, the FENX Digital name and marks, and code — are owned by FENX Digital or its licensors and are protected by intellectual property laws. You may view and share links to our content, and quote short excerpts with attribution, but you may not reproduce, republish, or commercially exploit the site or its contents without our written permission.
Client names, logos, and marks appearing on this site remain the property of their respective owners and are used to identify work performed.
Third-party links and platforms
The site links to third-party services such as scheduling, advertising, and analytics platforms. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of them is governed by their own terms.
Disclaimers
The site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.
Nothing on this site constitutes legal, financial, tax, or professional advice.
Limitation of liability
To the maximum extent permitted by law, FENX Digital and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of this site. Our total aggregate liability arising from your use of the site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnity
You agree to indemnify and hold FENX Digital harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the site.
Governing law and disputes
These terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-laws rules. You and FENX Digital agree to the exclusive jurisdiction of the state and federal courts located in Charleston County, South Carolina for any dispute that is not otherwise resolved informally.
